1. Acceptance of Terms

By accessing this website, submitting a form, booking an appointment, making a purchase, or otherwise using any service offered here, you confirm that you:

• Are at least 18 years of age, or are a parent/legal guardian acting on behalf of a minor client
• Have read and understood these Terms in full
• Agree to be legally bound by them

If you do not agree to these Terms, please do not use this website or its services.

2. Energy Healing Services — MindShifter Practice

Nature of Services

I offer energy healing sessions by Zoom video call. Sessions are based on energy work techniques and are intended for general wellness and relaxation purposes only. Results are not guaranteed and may vary from person to person.

Session Conduct

• All sessions are conducted remotely via Zoom. You are responsible for ensuring a stable internet connection.
• Sessions are for clients aged 18 and over, or for minors with a guardian present and appropriate signed consent on file.
• You agree to engage with sessions in good faith and to provide accurate health information where requested.
• I reserve the right to decline or discontinue service to anyone at any time.

Recording of Sessions

Sessions may only be recorded with the explicit written consent of both parties, as documented in the signed Consent & Waiver Agreement. Unauthorised recording by either party is not permitted.

No Guarantees

Energy healing is an emerging field and its effects are not universally accepted by the conventional medical community. I make no warranties, express or implied, that any session will produce a specific result, cure any condition, or improve any symptom.

3. Appointment Scheduling

Booking

Appointments are booked through the online calendar at /mindshifter/calendar/. A booking is confirmed only when you receive an email confirmation from me. Available time slots are shown in US Central Time (CT).

Cancellation & Rescheduling

• Please provide at least 24 hours' notice to cancel or reschedule a session.
• Late cancellations (less than 24 hours) or no-shows may result in forfeiture of your session at my discretion.
• I reserve the right to cancel or reschedule sessions due to illness, emergency, or technical failure. I will notify you as soon as possible and offer an alternative time.

Prerequisites

A valid signed Consent & Waiver Agreement must be on file before your first session. I will not proceed with a session without one. See Section 4 below.

4. Consent & Waiver Agreements

Before receiving energy healing services, all clients must complete and submit a signed Consent & Waiver Agreement. Four versions are available:

• Adult Client Agreement — for clients 18 and over based outside the EU
• Minor Client Agreement — for clients under 18, completed by a parent or legal guardian
• EU/GDPR Adult Agreement — for adult clients based in the EU/EEA
• EU/GDPR Minor Agreement — for minor clients with an EU-based guardian

Consent records are retained for a minimum of 7 years for professional insurance and legal compliance purposes. See our Privacy Policy for full details.

5. Donations

This website accepts voluntary donations through the Donate page to support my healing work.

• All donations are entirely voluntary and non-refundable.
• A donation does not create a contract for services, guarantee access to sessions, or confer any rights or entitlements.
• Donations are processed through third-party payment processors (e.g. PayPal). I do not store payment card information.
• Donations are not tax-deductible charitable contributions unless explicitly stated otherwise.

6. Art Purchases

Availability & Pricing

All artwork is subject to availability. Prices are listed in USD and do not include shipping or applicable taxes unless stated otherwise. I reserve the right to change prices at any time without notice; price changes do not affect orders already confirmed in writing.

Payment

Full payment is required at the time of purchase. I accept PayPal and major credit cards. All transactions are final unless stated otherwise in these Terms.

Shipping

I will ship confirmed orders to the address you provide within 5–14 business days of payment. Shipping costs are the buyer's responsibility unless otherwise specified. I am not liable for delays, damage, or loss caused by the shipping carrier once the item has been dispatched.

Returns & Refunds

• All sales are final due to the unique, one-of-a-kind nature of original artwork.
• Damaged items: If your artwork arrives visibly damaged, contact me within 7 days of delivery with photographs. I will work with you in good faith to arrange a replacement or partial refund at my sole discretion.
• Change of mind: I do not offer refunds or exchanges for change of mind, incorrect size assumptions, or screen colour differences.

7. Website Content — Reading & Personal Use

The following areas of this website contain free-to-read content for personal, non-commercial use only:

• Physics — Temporal physics research papers, essays, and proposed experiments

You may read, quote brief excerpts (with attribution), and share links to this content. You may not reproduce, copy, mirror, distribute, sell, or create derivative works from any content on this website without my prior written permission.

8. Intellectual Property

All content on this website — including but not limited to original artwork, novel text, physics research papers, audiobook recordings, website design, code, logos, photography, and written content — is the exclusive intellectual property of David Lee Williamson and is protected by applicable copyright, trademark, and intellectual property laws.

• Artwork: Purchase of a physical or digital artwork grants you personal ownership of that item only. All reproduction, distribution, and commercial rights are retained by me.
• The First Pulse: All text, characters, storylines, and narrative elements are original works protected by copyright. Unauthorised reproduction in any form is prohibited.
• Physics Research: All research papers, theoretical frameworks, and experimental proposals published on this site are original works. Academic citation with attribution is permitted; wholesale reproduction is not.
• Botua Content: Audio recordings and associated written material are protected by copyright. Downloading, re-hosting, or redistributing audio files is not permitted.
• Website Design & Code: The design, layout, and source code of this website are proprietary and may not be copied or reproduced.

9. Acceptable Use

You agree not to use this website or my services to:

• Transmit any malware, viruses, or harmful code
• Harass, threaten, or abuse me or other users of this site
• Use my content, name, likeness, or brand for commercial purposes without written permission
• Submit spam, unsolicited communications, or bulk messages via my contact forms

Violation of these terms may result in immediate termination of access and, where appropriate, legal action.

No Warranty

This website and all services are provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. I do not warrant that the website will be uninterrupted, error-free, or free of viruses or harmful components.

This website may contain links to third-party websites (e.g. Zoom, PayPal, Google Calendar). These links are provided for convenience only. I have no control over the content or practices of external sites and accept no responsibility for them.

11. Limitation of Liability

My total cumulative liability to you for any claim arising from or related to these Terms or my services shall not exceed:

• For energy healing sessions: the amount you paid for the specific session giving rise to the claim
• For art purchases: the purchase price of the artwork in question
• For all other matters: USD $100

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such cases, my liability will be limited to the maximum extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless David Lee Williamson from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to:

• Your use of this website or my services
• Your violation of these Terms
• Your violation of any applicable law or the rights of any third party
• Any false or inaccurate information you submitted through any form on this website

13. Changes to These Terms

I may update these Terms of Service from time to time to reflect changes in my services, legal requirements, or best practices. When I do:

• The updated Terms will be posted on this page with a new effective date
• Material changes will be highlighted at the top of this page for 30 days after publication
• Your continued use of this website or services after the updated effective date constitutes acceptance of the revised Terms

The previous version of these Terms was focused on art purchases only and was effective from March 23, 2025. This version supersedes it entirely.

14. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Texas, United States of America, without regard to its conflict of law provisions.

Any dispute, claim, or controversy arising from or related to these Terms or your use of this website that cannot be resolved informally shall be subject to the exclusive jurisdiction of the state and federal courts located in Collin County, Texas.

Before initiating any legal proceeding, you agree to contact me in good faith at david@davidleewilliamson.com to attempt to resolve the matter informally.
